From 2024, the classification of drones will become the central element for all new models. Until then, drones were divided into the OPEN A1/A3 or A2 categories depending on their take-off weight and required a corresponding license.
The change leads to a uniform classification and standardized norms, which increases safety when handling drones.

Dealers may sell their existing stocks, provided the models were first introduced to the EU market before January 1, 2024, whether by import or direct purchase from the manufacturer. There are therefore still a few last rarities on the market.
Your self-built or stock drone that weighs less than 250 grams falls into category A1. Here you may fly over uninvolved persons as long as the drone always remains in your field of vision and does not fly higher than 120 meters above the ground. However, flying over crowds of people is not permitted. Drone footage of crowds is increasingly being shared on Instagram and the like.
In most cases, a special take-off permit is required for this. Concerts and other events also require a permit and must therefore be prepared.
For drones without a C classification that weigh more than 250 grams and weigh up to 25 kg, the rules of sub-category A3 apply. This means that you must keep at least 150 meters away from people and areas such as residential, commercial or industrial areas.
The drone must also remain in your field of vision and may not fly higher than 120 meters. It is important to note that retrofitting a C classification to your drone is not permitted.

The operation of drones indoors remains unaffected by the regulations. However, it should be noted that receiving position data (GPS) in enclosed spaces is a challenge and can turn the flight into a real adventure, including unpredictable maneuvers. For this reason, flying indoors offers a more exciting challenge than free flying under the open sky. However, this is no obstacle for drone
experts who want to take control themselves.
When using FPV goggles, flying is permitted up to an altitude of 120 meters, but only in the presence of a spotter (official designation: airspace observer). The spotter assumes responsibility for monitoring the airspace and surroundings and ensures that VLOS operation (Visual Line of Sight, i.e. flying a drone within visual range) is observed.
The presence of a spotter during FPV flight is not only a good safeguard, but also practical in case you are approached during the flight. This allows the pilot to concentrate on the flight while the spotter keeps an eye on the surroundings and can provide an explanation to uninvolved third parties. Clear and direct communication between spotter and pilot is crucial for a safe flight.
The model flying associations can handle the EU rules somewhat more flexibly for their members. Membership of a model flying association could give you additional freedom if you want to fly your drone close to people. The associations offer special rules within Germany. For example, you are allowed to fly up to 30 meters without a spotter. You can find out more from the associations.
